DFARS Final Rule Updates ASBCA Charter


A final rule issued by the Department of Defense amends Appendix A, Part 1 of the Defense Federal Acquisition Regulation Supplement to update the Charter of the Armed Services Board of Contract Appeals. The rule replaces the July 1, 1979, version of the Charter with the latest May 14, 2007, version. The updated Charter implements changes to ASBCA internal administration to better support the board's mission of hearing, considering, and determining appeals by contractors from decisions of contracting officers or their authorized representatives or other authorities on disputed questions. The rule removes the two-year term limits for the Chairman and Vice-Chairmen and explicitly grants the board all powers necessary and incident to the proper performance of its duties, including authority to issue methods of procedures and rules and regulations for its conduct and for the preparation and presentation of appeals and issuance of opinions.
