BIS to Issue EAR License Documents in Electronic Form Only


An Export Administration Regulations final rule issued by the Bureau of Industry and Security addresses BIS' plan to eliminate the paper versions of most license-related documents. The rule impacts export and reexport licenses, notices of denial of license applications, notices of return of a license application without action, notices of results of classification requests, License Exception AGR notification results, and encryption review request results. Previously, BIS issued these license-related documents electronically through the Simplified Network Application Processing Redesign system and on paper. However, BIS now intends to discontinue issuing the paper version of these documents. BIS will continue to use paper documents when it authorizes a paper submission, when it must reissue a license-related document because it reopened a matter previously considered to be completed, and in certain other paper-based processes.

Recordkeeping Changes


Specifically, the rule revises EAR 740.18(c)(5) to clarify that electronic notification in SNAP-R is considered to be written notification of the results of a License Exception AGR request; EAR 750.7(b) to state BIS may issue export and reexport licenses either electronically or on paper; and EAR 750.7(h)(4) to remove a requirement for the license holder to attach a replacement license issued by BIS to the original license that it replaces. Also, the rule amends EAR 762.2 to exempt parties who submit documents via SNAP-R from requirements to retain copies of documents and to add three BIS notifications to the list of documents that must be maintained. Finally, the rule removes the requirement in EAR 748.7(c) for applicants to maintain a log of electronic submissions, and adds language to EAR 762.4 addressing retention of records issued through SNAP-R.
