NASA Issues Two Procurement Notices

The National Aeronautics and Space Administration has issued Procurement Notices 04-70 and 04-71. PN 04-70 reflects NASA's March 27, 2012, final rule (¶70,047.207) that updated the Award Fee for Service Contracts clause (NFS 1852.216-76) to clarify that the amount of award fee held in reserve, if any, shall not exceed $100,000 for the contract, and added similar language to the Award Fee for End-Item Contracts clause (NFS 1852.216-77) to allow the contracting officer to withhold fee payments, at a not-to-exceed amount of $100,000 for the contract, in reserve to protect the government's interests relative to an orderly and timely closeout of the contract. PN 04-71 adds new data elements to NASA's clause matrix at NFS 1852.301. Specially, NASA has revised the contract types listed in the NFS Matrix to match the clause templates in NASA's contract writing tool, the Contract Management Module, and has added a column for FAR Part 12 commercial item contract actions. NASA has also removed the columns for utilities, dismantling, demolition, or removal of improvements, and facilities contracts because these contract types are not included in the CMM clause template.
