SBA Considers Retraction of Nonmanufacturer Rule Waiver


The Small Business Administration is proposing to retract a class waiver of the nonmanufacturer rule (SBA 121.406 (b), SBA 125.15 (c), SBA 127.505) for Product Service Code 9130, Liquid Propellants, Petroleum Base, North American Industry Classification System code 324110. The nonmanufacturer rule requires recipients of federal supply contracts set aside for small businesses, service-disabled veteran-owned small businesses, women-owned small businesses, or participants in the SBA's 8(a) business development program to provide the product of a small business manufacturer or processor, if the recipient is other than the actual manufacturer or processor of the product. SBA finalized a waiver of the rule for PSC 324110 on June 8, 2009 (¶70,425.361). However, the Defense Logistics Agency was not aware of the proposed waiver until after the closing date for submission of comments, and it has awarded prime contracts to, or received offers from, multiple small business refiners.
