GSAR Provisions on Describing Agency Needs Revised

The General Services Administration has finalized, with changes, a proposed rule (¶70,033.55) amending GSAR Part 511, Describing Agency Needs. The final rule is a result of the GSA Acquisition Manual Rewrite initiative undertaken by GSA to revise the GSAM to maintain consistency with the Federal Acquisition Regulation and implement streamlined and innovative acquisition procedures that contractors, offerors, and GSA contracting personnel can utilize when entering into and administering contractual relationships. The GSAM incorporates the GSAR as well as internal agency acquisition policy. The rule substantially revises GSAR Subpart 511.2 by rewriting the solicitation provisions and contract clauses at GSAR 511.204 to accommodate the incorporation of clauses used by the former Federal Supply Service into the GSAR and to revise prescriptions for certain clauses. Ten new clauses from the Federal Acquisition Service, formerly the Federal Supply Service, are added to GSAR Subpart 511.2. Also, the rule substantially rewrites and clarifies GSAR Subpart 511.6, Priorities and Allocations, to reflect the Defense Priorities Allocation System delegation from the Department of Commerce. Further, the rule deletes seven clauses and makes technical changes. A proposed clause, Liquidated Damages for Phased Completion-Construction, and its prescription were deleted from the final rule.
