DoD Final Rule Makes Technical Changes


A final rule issued by the Department of Defense amends the Defense Federal Acquisition Regulation Supplement by making references to supplementary information and procedures pertaining to specific categories of acquisitions. The rule adds references at new DFARS 216.401 to additional information and mandatory procedures to follow when planning to award an award fee contract. The rule also adds at new DFARS 216.401-70 references to Section 814 of the National Defense Authorization Act for Fiscal Year 2007 (PL 109-364), which requires DoD to collect relevant data on award and incentive fees paid to contractors and have mechanisms in place to evaluate the data on a regular basis, and to the implementing procedures at PGI 216.401-70. Finally, the rule adds language at DFARS 237.102-74 and PGI 237.102-74 referencing the location of a taxonomy for acquisition of services to facilitate strategic sourcing within DoD.
