New
Smart Chart for CCH Consumer Credit Guide (Internet)
Gift
Card coverage has been added to the topics that can be researched and displayed
in Consumer Credit Smart Charts, which enable multijurisdictional research of a
subject with links to relevant laws, regulations and explanations.
The
Gift Cards Smart Chart focuses on state gift card laws relating to fee and
expiration date restrictions and disclosure requirements. Types of cards and
instruments covered and excluded by state law are also included.
Gift
cards continue to grow in popularity and are projected to continue to increase
in volume. As
a result, many states have regulated what terms and conditions can be imposed
upon a user of a gift card by the issuer.
The
Consumer Credit Card Gift Card Topics Smart Chart supplements the four
previously issued Topics Smart Charts (interest-usury, retail installment
sales, home solicitation sales, credit card charges and fees), as well as the
four Consumer Credit Quick Reference Smart Charts (predatory lending,
payday lending, title loans and refund anticipation loans) and the Consumer
Credit Legislative Developments Smart Chart.
New
Smart Chart for
This
new Smart Chart on “Standing and Types of Actions Permitted” focuses on
three of the major issues in the area of law—who may file private actions
under the state laws, whether there is a private right of action for damages,
and whether there is a private right of action for injunctive relief. These
issues are threshold issues in a potential suit, since some states do not allow
private actions and others limit them to those brought by consumers, excluding
competitors and other third parties. This chart is quite comprehensive, citing
case law in addition to linking to both the text of the laws and the “state
summary page,” a chart in the reporter. This is the fourth Smart Chart added
to the Antitrust and Trade Regulation tab on the CCH Internet Research NetWork
since August.

A

Previously available only on a temporary basis, these white papers are now accessible in a single permanent archive, in both text-searchable and PDF format. The link to this database appears in the Securities tab on the CCH Internet Research NetWork under the “Current Developments” blue bar. It will be updated periodically as warranted by regulatory developments.
