The Leahy-Smith America Invents Act, which was signed into law on September 16, makes the most sweeping changes to patent law in decades, including transitioning the United States from a "first to invent" system to a "first inventor to file" system, which is similar to those used in virtually every other jurisdiction around the world. The law further will preclude the grant of "tax strategy patents" and patent claims encompassing human organisms; grant the U.S. Patent and Trademark Office the authority to set fees on a cost-recovery basis; impose a surcharge for applications not filed electronically; and eliminate qui tam actions for false patent marking claims. Other changes provide a nine-month window for challenging a patent on any ground and require petitioners to satisfy a preponderance of the evidence burden of proof. Most provisions of the law (H.R. 1249, Public Law 112-29) will become effective a year after enactment, with some taking immediate effect.
